Councilmember Cook stated that they have no reason to disbelieve how the building was <br />constructed and the situation is that the building exists and someone is stuck with it. <br /> <br />Councilmember Kurak stated that she did not understand why the City should have to <br />accommodate a landowner's use of their property. If Mr. Menard combines the two lots, he has a <br />home on the property. <br /> <br />Councilmember Cook stated that if he had some proof that said that the City did not tell him to <br />build the building on his other parcel and Mr. Menard went ahead and did so anyway that would <br />be a different situation. <br /> <br />Councilmember Elvig stated that someone gave Mr. Menard a permit to build a building without <br />a home. <br /> <br />Community Development Director Frolik noted that staff has been unable to find any evidence <br />that a permit was issued for the building. <br /> <br />Councilmember Kurak pointed out the fact that Mr. Menard was advised in 1992 by staff that he <br />needed a conditional use permit to legalize the commercial use of the property, but Mr. Menard <br />did not follow up and apply for the permit. <br /> <br />Mr. Menard inquired if the zoning change to mixed use would be a possibility, if other property <br />owners agree with the change. <br /> <br />Councilmember Kurak replied that it is an option, but she did not think that the Council would <br />want to set a precedent of allowing commercial uses in a residential area without a home on the <br />property. She felt that the only two options were to change the zoning to mixed use or combine <br />the two lots. <br /> <br />Councilmember Strommen inquired as to why the City would change the zoning to mixed use, if <br />it would still require a home to be built on the property. <br /> <br />Councihnember Cook explained that the mixed-use zoning would allow for more commercial <br />uses on the property. <br /> <br />Mr. Menard stated that he would talk to his neighbors about the rezoning to mixed use. <br /> <br />Mayor Gamec stated that Mr. Menard would have to make the decision on how he wants to <br />proceed and make the appropriate application to the Council. <br /> <br />City Council Work Session/March 18, 2003 <br /> Page 6 of 9 <br /> <br /> <br />
