stated that he was opposed to the trail and that thc children would not use the trail to walk to <br />school; they would stay on the sidewalks. Overall he felt that the development was too dense, <br />but he was willing to be flexible on that issue. <br /> <br />Tim Yehle, 6121 - 145th Lane NW, stated that he was opposed to having a trail in his backyard. <br />He explained that the trail would come five feet from his screened gazebo. In regards to children <br />walking to school, his children are bussed and do not walk to school. His other area of concern <br />had to do with water coming onto his property because he has a low, flat backyard. Mr. Yehle <br />stated that he wants to be assured that he will not have water in his back yard. <br /> <br />Mayor Gamec replied that the water issues would be addressed. <br /> <br />Councilmember Cook proposed that a sidewalk be constructed along the west side of 145th Lane <br />and then the proposed southerly trail be removed from the proposed development. <br /> <br />Julie Horn, 6031 - 145th Lane NW, stated that John and Sandy Bertzyk went around the entire <br />perimeter of the proposed development to get recommendations from people regarding the trail <br />and it was a strong 'no' that people did not want the trail. She did also have an opportunity to <br />watch the Park Commission meeting and it seemed to her that the trail was being very strongly <br />advocated by Mr. Boos rather than the Park Commission. <br /> <br />Councihnember Elvig stated that he did not want to see everyone installing six-foot fences <br />adjacent to open space because of a trail, so he felt that the proposal of the sidewalk along 145th <br />Lane would resolve some of the concerns. <br /> <br />Todd Bjerstedt, Todd Allen Homes, stated that they would be very happy to work with the <br />Engineering department on drainage issues. He also noted that the minimum driveway length <br />being proposed was 22 feet and 90 percent of the cottage homes will not have children. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt Resolution #03- <br />02-055 adopting Findings of Fact #0643 relating to a request to rezone the subject property from <br />R-1 Single Family to PUD Planned Unit Development. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Elvig, and Pearson. <br />Voting No: Councilmembers Strommen and Zimmerman. Abstained: Councilmember Kurak. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to introduce an <br />ordinance to rezone the subject property from R-1 Single Family to PUD Plam~ed Unit <br />Development, based on the findings of facts. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Pearson, and Elvig. <br />Voting No: Councilmembers Strommen, and Zimmerman.
