Councilmember Elvig stated that he does not want to do anything to delay the Town Center
project, but he is not sure of the legalities.

City Attorney Goodrich explained that the legality of acquiring the right of way would require a
negotiated agreement with the land owner or condemnation of the property.

Mayor Gamec stated that what he worries about is making sure the City receives the funds if the
City spends money on the project.

Councilmember Kurak inquired if the City were to accept the grant, and then the City decided
not to spend money on the project, would the City be committed to spending the money?

Principal City Engineer Olson replied no.

Mayor Gamec stated that he wants something in writing from the Met Council committing them
to the grant.

City Attorney Goodrich stated that he did feel that accepting the grant would require that the City
acquire the land.

Councilmember Elvig inquired if the City would be in a better negotiating status if they delay the
acceptance of the grant.

Councilmember Kurak noted that Mr. Feges was a party to applying for the grant.

Motion by Mayor Gamec, seconded by Councilmember Zimmerman, to table action until the
next City Council meeting.

Further discussion: Councilmember Strommen inquired if staff felt that they would be at a
disadvantage by not acting on the acceptance of the grant for two weeks. Principal Planner
Trudgeon replied that he did not believe so. He noted that the grant states that all of the funds
have to be expended by December 31, 2004 and will be effective upon execution of the
agreement by the Met Council.

Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Zimmerman, Elvig, Pearson,
and Strommen. Voting No: Councilmember Cook. Abstained: CouncilmemberKurak.

Case #8: City of Ramsey Capital Improvement/Capital Outlay Plan

City Administrator Norman stated that the Council was presented Ramsey's 2003-2007 Capital
Improvement~Capital Outlay Plan at an earlier work session. A work session was held February
24, 2003, to answer any questions and/or concerns that Council had regarding the C~ document.
The CIP has been prepared in an attempt to anticipate major capital expenditures in advance of
the year in which they are budget requests. Approval of the CIP by Council does not authorize
spending or initiation of a given project. It does, however, provide a guide for the community for

City Council/February 25, 2003
