1 a. Structures and facilities must comply with the following standards unless identified as <br /> 2 exempt in section 117-148(I) (exemptions): <br /> 3 1. ROS District: 35 feet. <br /> 4 2. RN District: 35 feet. <br /> 5 3. SR District: Height is determined by underlying zoning, provided the allowed <br /> 6 height is consistent with that of the mature treeline, where present, and existing <br /> 7 surrounding development, as viewed from the OWHL of the opposite shore. <br /> 8 b. Height is measured on the side of the structure facing the Mississippi River. <br /> 9 C. In addition to the conditional use permit requirements of section 117-148(c)(4), <br /> 10 (conditional and interim use permits) criteria for considering whether to grant a <br /> 11 conditional use permit for structures exceeding the height limits must include: <br /> 12 1. Assessment of the visual impact of the proposed structure on public river corridor <br /> 13 views, including views from other communities; <br /> 14 2. Determination that the proposed structure meets the required bluff and OHWL <br /> 15 setbacks; <br /> 16 3. Identification and application of techniques to minimize the perceived bulk of the <br /> 17 proposed structure, such as: <br /> 18 (i) Placing the long axis of the building perpendicular to the river; <br /> 19 (ii) Stepping back of portions of the facade; <br /> 20 (iii) Lowering the roof pitch or use of a flat roof; <br /> 21 (iv) Using building materials or mitigation techniques that will blend in with the <br /> 22 natural surroundings such as green roofs, green walls, or other green and <br /> 23 brown building materials; <br /> 24 (v) Narrowing the profile of upper floors of the building; <br /> 25 (vi) Increasing the setbacks of the building from the Mississippi River or <br /> 26 blufflines; <br /> 27 (vii) Identification of techniques for preservation of those view corridors <br /> 28 identified in the MRCCA plan; and <br /> 29 (viii) Opportunities for creation or enhancement of public river corridor views. <br /> 30 (3) Structure and impervious surface placement. <br /> 31 a. Structures and impervious surface must not be placed in the shore or bluff impact zones <br /> 32 unless identified as an exemption in section 117-148(I) (exemptions). <br /> 33 b. Structures and facilities must comply with the following OHWL setback provisions <br /> 34 unless identified as exempt in section 117-148(I) (exemptions): <br /> 35 1. ROS District: 200 feet from the Mississippi River. <br /> 36 2. RN District: 100 feet from the Mississippi River and :75 I eetfeet I,Ireng the Rum RiveF <br /> 37 C. Structures and facilities must comply with the following bluffline setback provisions <br /> 38 unless identified as exempt in section 117-148(I) (exemptions): <br /> 39 1. ROS District: 100 feet. <br /> 40 2. RN District: 40 feet. <br /> 41 3. SR District: 40 feet. <br /> 42 d. Where principal structures exist on the adjoining lots on both sides of a proposed <br /> 43 building site, the minimum setback may be altered to conform to the average of the <br /> 44 adjoining setbacks, provided that the new structure's scale and bulk riverward or <br /> 45 bluffward of the setbacks required under section 117-148(f)(3) (Structure and <br /> 46 impervious surface placement) consistent with adjoining development.
