Subsurface sewage treatment systems, including the septic tank and absorption area, <br /> 3 must be located at least 75 feet from the ordinary high water level of the Mississippi <br /> 4 River and all other public waters. <br /> 5 (4) Lot size and buildable area. <br /> 6 a. The width of lots abutting the Mississippi River in the ROS District must be at least 200 <br /> 7 feet, unless alternative design methods are used that provide greater protection of the <br /> 8 riparian area. <br /> 9 b. All new lots must have adequate buildable area to comply with the setback <br /> 10 requirements of section 117-148(f)(3) (structure and impervious surface placement)so <br /> 11 as to not require variances to use the lots for their intended purpose. <br /> 12 (G) Performance standards for private facilities. <br /> 13 (1) Purpose. To establish design standards for private facilities that are consistent with best <br /> 14 management practices and that minimize impacts to primary conservation areas, public river <br /> 15 corridor views and other resources identified in the MRCCA plan. <br /> 16 (2) General design standards. All private facilities must be developed in accordance with the <br /> 17 vegetation management and land alteration requirements in sections 117-148(i) (vegetation <br /> 18 management) and 117-148(j) (land alteration standards and stormwater management). <br /> 19 (3) Private roads, driveways, and parking areas. Except as provided in section 117-148(I) <br /> 20 (exemptions), private roads, driveways and parking areas must: <br /> 21 a. Be designed to take advantage of natural vegetation and topography so that they are <br /> 22 not readily visible; <br /> 23 b. Comply with structure setback requirements according to section 117-148(f)(3) <br /> 24 (structure and impervious surface placement); and <br /> 25 C. Not be placed within the bluff impact zone or shore impact zone, unless exempt under <br /> 26 section 117-148(I) (exemptions) and designed consistent with section 117-148(f)(2) <br /> 27 (general design standards). <br /> 28 (4) Private water access and viewing facilities. <br /> 29 a. Private access paths must be no more than: <br /> 30 1. Eight feet wide, if placed within the shore impact zone; and <br /> 31 2. Four feet wide, if placed within the bluff impact zone. <br /> 32 b. Private water access ramps must: <br /> 33 1. Comply with Minnesota Rules, chapters 6115.0210 and 6280.0250; and <br /> 34 2. Be designed and constructed consistent with the applicable standards in Design <br /> 35 Handbook for Recreational Boating and Fishing Facilities. <br /> 36 C.
