1 (6) Off-premise and directional signs. <br /> 2 a. Off-premise advertising signs must: <br /> 3 1. Meet required structure placement and height standards in section 117-148(f) <br /> 4 (structure height and placement and lot size). <br /> 5 2. Not be readily visible. <br /> 6 b. Directional signs for patrons arriving at a business by watercraft must comply with the <br /> 7 following standards: <br /> 8 1. They must be consistent with Minn. Stats. §8613.115. <br /> 9 2. Only convey the location and name of the establishment and the general types of <br /> 10 goods and services available, if located in a shore impact zone. <br /> 11 3. Be no greater than ten feet in height and 32 square feet in surface area; and <br /> 12 4. If illuminated,the lighting must be shielded to prevent illumination out across the <br /> 13 river or to the sky. <br /> 14 (7) Fences. Fences between principal structures and the river are allowed provided that fences <br /> 15 are: <br /> 16 a. Not higher than six feet. <br /> 17 b. Not located within 40 feet of slopes greater than 12%. <br /> 18 C. Not located in the regulatory floodplain. <br /> 19 (H) Performance standards for public facilities. <br /> 20 (1) Purpose. To establish design standards for public facilities that are consistent with best <br /> 21 management practices and that minimize impacts to primary conservation areas, public river <br /> 22 corridor views and other resources identified in the MRCCA plan. Public facilities serve the <br /> 23 public interest by providing public access to the Mississippi River corridor or require locations <br /> 24 in or adjacent to the river corridor and therefore require some degree of flexibility. <br /> 25 (2) General design standards. In addition to the standards set forth above, all public facilities <br /> 26 must be designed and constructed to: <br /> 27 a. Minimize visibility of the facility from the river to the extent consistent with the purpose <br /> 28 of the facility; <br /> 29 <br /> 30 , <br /> 31 r�v�rvr+i�r►c�• <br /> r�- <br /> 32 G. Avoid primary conservation areas, unless no alternative exists. If no alternative exists, <br /> 38 then disturbance to primary conservation areas must be avoided to the greatest extent <br /> 39 practicable, and design and construction must minimize impacts; and <br /> 40 e. Minimize disturbance of spawning and nesting times by scheduling construction at <br /> 41 times when local fish and wildlife are not spawning or nesting. <br /> 42 (3) Right-of-way maintenance standards. Right-of-way maintenance must comply with the <br /> 43 following standards: <br /> 44 a. Vegetation currently in a natural state must be maintained to the extent feasible; <br /> 45 b. Where vegetation in a natural state has been removed, native plants must be planted <br /> 46 and maintained on the right-of-way; and <br /> 47 C. Chemical control of vegetation must be avoided when practicable, but when chemical <br /> 48 control is necessary, chemicals used must be in accordance with the regulations and <br /> Page 102 of 147 <br />
