1 2. The minimum necessary for development that is allowed as an exception under <br /> 2 section 117-148(I) (exemptions); and <br /> 3 3. Repair and maintenance of existing buildings and facilities. <br /> 4 b. Within the water quality impact zone, land alteration that involves more than ten cubic <br /> 5 yards of material or affects an area greater than 1,000 square feet requires a permit. <br /> 6 (3) Rock riprap, retaining walls, and other erosion control structures. <br /> 7 a. Construction, repair, or replacement of rock riprap, retaining walls, and other erosion <br /> 8 control structures located at or below the OHWL must comply with Minnesota Rules, <br /> 9 chapters 6115.0215, subpart 4, item E, and 6115.0216, subpart 2. Work must not <br /> 10 proceed until approved by the commissioner. Construction or replacement of rock riprap, retaining walls, and other erosion control <br /> 13 structures within the bluff impact zone and the water quality impact zone are allowed with a <br /> 14 permit <br /> 15 provided that: <br /> 16 1. If the project includes work at or below the OHWL, the commissioner has already <br /> 17 approved or permitted the project. <br /> 18 2. The structures are used only to correct an established erosion problem as determined <br /> 19 by the City of Ramsey. <br /> 20 3. The size and extent of the structures are the minimum necessary to correct the erosion <br /> 21 problem and are not larger than the following, unless a professional engineer <br /> 22 determines that a larger structure is needed to correct the erosion problem: <br /> 23 (i) Retaining walls must not exceed five feet in height and must be placed a minimum <br /> 24 horizontal distance of ten feet apart; and <br /> 25 (ii) Riprap must not exceed the height of the regulatory flood protection elevation. <br /> 26 c. Repair of existing rock riprap, retaining walls, and other erosion control structures above the <br /> 27 OHWL does not require a permit provided it does not involve any land alteration UndeF <br /> 28 secti-e-n 1 t 't) <br /> 29 (4) Stormwater management. <br /> 30 a. In the bluff impact zone, storm water management facilities are prohibited except by <br /> 31 permit if: <br /> 32 1. There are no alternatives for storm water treatment outside the bluff impact zone <br /> 33 on the subject site; <br /> 34 2. The site generating runoff is designed so that the amount of runoff reaching the <br /> 35 bluff impact zone is reduced to the greatest extent practicable; <br /> 36 3. The construction and operation of the facility does not affect slope stability on <br /> 37 the subject property or adjacent properties; and <br /> Page 106 of 147 <br />
