Goodrich mentioned penalties for other cities. We may be a little exorbitant on that fine. All <br />indications before was to have a three-day suspension on a weekend, but after checking it out, it <br />could be $60,000 to $70,000 lost for them. That's out of line. Mayor Gamec stated he would <br />have to look at a minimum of one of the weekend days or maybe at the most two. We do not <br />want to put Diamonds out of business. We want this to be an example and we want you to take <br />heed with what we are saying. If it happens again in the next six months or so, he would not be <br />willing to bend on a penalty at all. <br /> <br />Councilmember Anderson stated that for this type of violation, the City needs to hold Diamonds <br />to a higher standard. A sale to a minor - people would say it should not happen - but they will <br />overlook it. She stated that strippers make our town look "skuzzy". Diamonds may have to exist <br />on food and ballgames. Suspension of their liquor license for this weekend (Friday, Satm'day <br />and Sunday) would be her idea. <br /> <br />Mr. Gruber stated he is willing to take a monetary fine but suspension for the weekend would <br />cost him about $50,000. <br /> <br />Councihnember Anderson stated that he should have thought of that before to which Mr. Gruber <br />stated he did not realize it was a violation of his liquor license. <br /> <br />Mayor Gamec suggested looking at a two-day suspension - Thursday and Friday. <br /> <br />Councilmember Hendriksen stated that the shorter we go and move off of a weekend - then the <br />greater the penalty should be - then we should go beyond 10 days total with regard to a <br />reoccurrence. If it's one day and it's a Monday - it should be 29 days suspension. If it's a <br />Friday - then less days. Are we permitted to fine and suspend? <br /> <br />Mr. Goodrich stated that we are not permitted to fine. <br /> <br />Mr. Nash stated that they are willing to accept the longer amount of time on the back end to <br />show you it will not happen again. We have to have something on the front end to survive. <br /> <br />Councilmember Hendriksen stated that we cannot do anything about this happening. Are we <br />going to make this so onerous that Diamonds will have no other choice but to fight it out in <br />court. We should pick something on the front end bearing in mind we really want to accomplish <br />that this will not happen again. <br /> <br />Councihnember Anderson inquired what if we have a liquor violation next week but it's selling <br />to underage. <br /> <br />Mr. Goodrich replied that this is a violation of conduct only - it would be a separate violation but <br />it would be the second violation. <br /> <br />Councihnember Hendriksen stated that he does not put the two of those in the same category - <br />this was an overt intentional action and they are saying they had no idea this was a violation. <br /> <br />City Council/Special Meeting/April 6, 1999 <br /> Page 4 of 5 <br /> <br /> <br />
