Councilmember Zimmerman aye <br />Mayor Gamec absent <br /> <br />Motion carried. <br /> <br />Case #3: <br /> <br />Request for a Conditional Use Permit to Exceed the Total Accessory <br />Structure Space and the Maximum Single Accessory Structure Size <br />Restrictions; Case of Francis and Teresa Moulzolf <br /> <br />Zoning Administrator Frolik stated that she received an application from Francis and <br />Teresa Moulzolf for a conditional use permit to exceed the total accessory <br />structure/garage space allowed and the maximum single accessory structure size <br />restrictions on their property at 14260 Junkite Street NW. Ms. Frolik explained that the <br />subject property is 1.4 acres in size and is restricted to a total of 1,664 square feet of <br />garage and accessory building space. In addition, there is an 800 square foot size <br />restriction on any single accessory structure. The Moulzolf's currently have a 600 square <br />foot attached garage and a 450 square foot detached garage. They are proposing to <br />remove the 450 square foot detached garage and replace it with a 1,152 square foot <br />garage in which to store personal vehicles and equipment, specifically a motorhome. She <br />noted that the Planning Commission conducted a public heating and there were no verbal <br />or written comments received. Ms. Frolik reported that Mr. Moulzolf called her and <br />wants to re-evaluate the size requested. He would like to add 144 square feet to what the <br />Planning Commission saw and made their recommendation on. <br /> <br />City Attorney Goodrich commented that maybe a new public hearing would have to be <br />held. <br /> <br />Councilmember Hendriksen felt that Mr. Moulzolf is exceeding the requirement by such <br />a small amount to begin with that it's relatively minor in relationship to the building. <br /> <br />Councilmember Zimmerman noted that there was no comment at the public heating. <br /> <br />Councilmember Anderson suggested it might be wise to send this back to the Planning <br />Commission just to be certain there are no problems with the requested addition of square <br />footage. <br /> <br />Councilmember Hendriksen reiterated that on an 1,152 square foot building, this amount <br />is almost negligible. <br /> <br />Councilmember Haas Steffen asked for legal advice. <br /> <br />Attorney Goodrich responded that since there were no comments at the public heating <br />and this request seems relatively insignificant, Council can legally move forward. <br /> <br />Ms. Frolik stated that this reasoning would have to be ~not...~in the findings. <br /> <br />City Council/January 26, 1999 <br /> Page 6 of 17 <br /> <br /> <br />
