Council approval, which she believed was up to 60 days following submittal. She <br />expressed the hope that some issues could be ironed out ahead of time so the Met Council <br />would not have to use the entire 60 days for review. <br /> <br />Rick Burnham stated he is willing to work with the City and stated he would like to see <br />this get done. He believed the project will be an asset for the City of Ramsey. <br /> <br />Robert Bargo, representing the sellers, understood that this area would still be included in <br />industrial and wondered if the Planning Commission could start to review the plans in the <br />interim. <br /> <br />City Attorney Goodrich stated that we could go through the approval process with <br />contingencies, however, that would be done at the client's risk. <br /> <br />Councilmember Haas Steffen commented that, unless City services are brought to this <br />area, this request might not be allowed and we are not contemplating services to this area <br />between the years 2005 and 2010. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Hendriksen to <br />send this back to the Planning Commission with the caveat that this could be <br />recommended for approval if the owner of the property and the proposed buyer want to <br />take the risks and that they are aware of all risks. <br /> <br />Further discussion: Councilmember Hendriksen wondered if that has been the City's <br />practice as The Diamonds Sports Bar was allowed to go in. Ms. Sherman responded that <br />this is the policy that's being proposed in the Comprehensive Plan - the new policy. <br />Councilmember Hendriksen speculated that #116 may continue and he wondered if staff <br />has looked at this issue with regard to what has been anticipated. Ms. Sherman replied <br />that there is a drainage and easement set aside and probably a road easement too. <br />Councilmember Hendriksen suggested that we have allowed things to proceed in the past <br />and then when denied - it gave the applicant some legal leverage. He asked staff to make <br />certain that we are not creating any legal liability for the City. City Attorney Goodrich <br />stated that is why we are making sure approval is entirely contingent on the <br />Comprehensive Plan and getting the proper zoning and that the applicants know there is a <br />risk. <br /> <br />Amendment by Councilmember Haas Steffen and seconded by Councilmember <br />Hendriksen to add to the motion that the risks to the applicant are put in writing and that <br />it all gets approved by the City Attorney. <br /> <br />Amendment carried. Voting Yes: Councilmembers Haas Steffen, Hendriksen, Anderson <br />and Zimmerman. Voting No: None. Absent: Mayor Gamec. <br /> <br />Motion carried. Voting Yes: Councilmembers Haas Steffen, Hendriksen, Anderson and <br />Zimmerman. Voting No: None.
