Cotmcilmember Haas Steffen inquired if the lawsuit gets pushed forward, will a judge <br />take into consideration what is being proposed or what's in effect? <br /> <br />Mr. Goodrich responded that generally it would be what's in effect. <br /> <br />Councilmember Haas Steffen stated she is interested in hearing from the Metropolitan <br />Council with regard to the MUSA line. <br /> <br />Councilmember Zimmerman stated we are working at it - moving forward. <br /> <br />Councilmember Haas Steffen stated she thought the attorney was going to tell us what <br />would happen after meetings where we might have a difference with the Planning <br />Commission. <br /> <br />Mr. Goodrich stated that the Planning Commission should hold one public hearing and <br />make a recommendation to the City Council. The City Council reviews it and sends it to <br />the Metropolitan Council. It will be before the City Council for final adoption. Unless <br />there are substantial changes, an additional public hearing would not be required but if <br />after a discussion, you have changed it enough and you want to, you could schedule a <br />public hearing; it is not mandated that you do that. <br /> <br />Motion by Councihnember Zimmerman and seconded by Councilmember Hendriksen to <br />request that the Metropolitan Council extend the moratorium filing date for an additional <br />60 days (May 30). <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson and Haas Steffen.
