Voting No: None. <br /> <br />Case//4: <br /> <br />Request for a Conditional Use Permit to Exceed the Total Amount of <br />Accessory Building Space and the Single Building Size Restriction on <br />a Parcel; Case of Jeffrey Sigler <br /> <br />Zoning Administrator Frolik stated that the City received an application from Jeffrey <br />Sigler for a conditional use permit to exceed the total amount of accessory building space <br />and the single building size restrictions on his property at 17151 Baugh Street NW. Mr. <br />Sigler raises horses and likes to ride year around. He is proposing to construct a 5,100 <br />square foot indoor riding arena. His property is 10 acres in size and City Code allows a <br />total of 5,264 square feet of garage and accessory building space on the property; and no <br />single building should exceed 4,400 square feet in size. He currently has a 1,104 square <br />foot attached garage and a 1,200 square foot stable, for a total of 2,304 square feet of <br />accessory building space. This leaves him with a remaining accessory structure allotment <br />of 2,960 square feet. His proposal for an indoor riding arena is a 2,140 square foot <br />overage in the total amount of accessory structure space allowed on the property and a <br />700 square foot overage in the single building size restriction. Ms. Frolik noted that the <br />property is located in the Rural Service Area where there is currently a density zoning <br />restriction of four units per 40 acres. The Planning Commission met on April 6, and <br />conducted a public hearing regarding Mr. Sigler's request. There were no verbal or <br />written comments submitted to the Commission. The Commission recommended <br />approval of the request. <br /> <br />Councilmember Hendriksen inquired if Mr. Sigler reviewed the findings to which Ms. <br />Frolik responded that he had at the Planning Commission and that the findings were also <br />mailed to him. He did not speak to them. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Resolution #99~04-066 adopting Findings of Fact #0489 relating to a request from <br />Jeffrey Sigler for a conditional use permit for an overage in the accessory building size <br />restriction and the total amount of accessory building space allowed on a parcel of land. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen <br />and Anderson. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Resolution #99-04-067 approving the issuance of a conditional use permit based on <br />Findings of Fact//0489 and declaring terms of permit to exceed the total amount of <br />accessory building space and the single building size restriction on a parcel of land. <br /> <br />Motion carried.
