Case #5: <br /> <br />Request for a Conditional Use Permit to Alter the Landscape of <br />Property Located in the Rum River Scenic Overlay District: Case of <br />T.V. Rao <br /> <br />Zoning Administrator Frolik stated that the City received an application from T.V. Rao at <br />14359 Waco Street NW, to re-grade and stabilize the bluff line along the Rum River on <br />his property. The property is located in the Rum River Scenic Overlay District. Mr. Rao <br />had commenced work to stabilize and prevent further erosion of the river bank on his <br />property, unaware that a conditional use permit is required for this kind of project in the <br />Overlay District. Upon notification by City staff of the need for a permit, work stopped <br />and Mr. Rao immediately submitted the necessary applications, fees and plans. Ms. <br />Frolik reported that in the last 10 years, Mr. Rao estimates that they have lost at least <br />eight feet of riverbank due to erosion. He is proposing to re-grade the bluff to a workable <br />slope and stabilize it with the use of rip rap and native plants and grasses. The Planning <br />Commission conducted a public hearing on April 6, and there was one letter of support <br />received from an area resident. There were no objections raised to Mr. Rao's request. <br />The DNR received the application and they solicit reviews from all pertinent <br />jurisdictions. Ms. Frolik advised that she has received a favorable review by the DNR <br />via the telephone, however, she has not received formal written comments. <br /> <br />Motion by Councilmember Anderson and seconded by Councilmember Zimmerman to <br />adopt Resolution #99-04-068 adopting Findings of Fact #0490 relating to a request from <br />T.V. Rao for a conditional use permit to alter the landscape on a parcel located in the <br />Rum River Scenic Overlay District. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Zimmerman <br />and Hendriksen. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />adopt Resolution #99-04-069 approving the issuance of a conditional use permit, pending <br />written verification from the DNR, based on Findings of Fact #0490 and declaring terms <br />of permit to alter the landscape of property in the Rum River Scenic Overlay District. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for Site Plan Review; Case of LifeFitness-ParaBody, A <br />Division of Brunswick Corporation <br /> <br />Zoning Administrator Frolik reported that the City has received a request for site plan <br />review and approval from ParaBody-LifeFitness for an expansion to the existing facility <br />at 14150 Sunfish Lake Boulevard NW. The existing ParaBody building is 56,648 square <br />feet in size and is located on Lot 2, Block 1 of Gateway North Industrial Park Plat 4. <br />They are proposing a 208,016 square foot addition to the facility that will extend onto Lot <br />3 to the north. To accommodate this expansion, ParaBody is also in the process of re- <br />platting the two lots into one lot and one outlot.
