Voting No: None. <br /> <br />Case #13: Adopt Resolution Declaring Vacancy of Council Seat <br /> <br />City Attorney Goodrich stated that Councilmember Natalie Haas Steffen submitted her <br />resignation as a City Councilmember, effective April 22, 1999, due to her appointment to <br />the Metropolitan Council. Council must, by resolution, declare the vacancy, thus creating <br />the need for a special election. As verified through the Anoka County Elections <br />Supervisor, the very last date the election can be held is July 26. Staff is recommending <br />the election be scheduled for July 20, 1999, from 7:00 a.m. to 8:00 p.m., with all five <br />precincts open. Paper ballots will be used and the term will be only for the remainder of <br />the term of Natalie Haas Steffen, which is up December 31, 2000. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Resolution #99-04~070 declaring a vacancy on the City Council and calling for a <br />special election to fill the vacancy. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen <br />and Anderson. Voting No: None. <br /> <br />Case #14: Report from Public Works Committee <br /> <br />1) Update of T.H. #47 STP Project <br /> <br />City Engineer Jankowski reported that six relocation purchases have been authorized and <br />there are a number of closings scheduled for May. No Council action is necessary. <br /> <br />2) Discuss Drainage Issue at Intersection of 164th Lane and C.S.A.H. #5 <br /> <br />Mr. Jankowski reported that the Committee discussed whether the City has the ability to <br />prevent a property owner from pumping water onto another property through <br />enforcement action. Staff discussed this with the City Attorney. It was also agreed that <br />the key to a solution in this particular situation was the ability to ultimately drain the run- <br />off to the DNR-protected wetland to the east. The Public Works Committee directed <br />staff to contact the property owners south of 164th Lane to discuss a solution and <br />necessary easements. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />contact the property owners south of 164th Lane to discuss a solution and necessary <br />easements. <br /> <br />Motion carried.
