Gustafson has inspected the site of the event and it is properly fenced. Staff is <br />recommending approval of the license application and Chief Gustafson recommends that <br />outdoor liquor sales and music cease at 9:00 p.m. versus 9:30 p.m. She noted that the <br />license has been drafted accordingly. <br /> <br />Gary Gruber, one of the owners of Diamonds, stated that since his case went into <br />Council's packet, they rant into a dilemma with the Lions and parking on Mr. Pearson's <br />property. Mr. Pearson rents that property and the owner does not want parking there. <br />Therefore, we will be parking on our own property which would be the ball diamonds <br />plus he said they would be asking for use of the easement for overflow of the property. <br />(The easement is what was deeded back to the City for the future Riverdale.) He met <br />with the Lions and they want to do this. We planned before that the Lions will charge a <br />$3 parking fee and that would pay their expense and profit. Now the Lions will be <br />helping at our property and we will donate $2 of each ticket sale to the Lions for their <br />help. That would help both them and us. He noted there was a member of the Lions <br />present and also a member from the entertainment company who puts up the lighting and <br />sound. He added that they will also hire a security company. With regard to the <br />recommendations, staff is recommending liquor and music cease at 9:00 p.m. He is in <br />agreement with the liquor sales outside ceasing at 9:00 but asked if they could have a 30 <br />minute window on the music which would allow for encores, etc. He reported that Joan <br />Jett, the headliner, is scheduled to play from 7:30 to 9:00 p.m. With regard to the <br />insurance, it states that Diamond's needs to have insurance for one year. They do have <br />insurance on the property and will be purchasing an additional rider. The rider is good <br />for that day and it's in effect for 30 days and is also good for 18 months. The third <br />recommendation was for providing police protection. He reiterated that they will be <br />hiring Asia Security. They (Diamonds) have talked with Police Chief Gustafson as well <br />as the security company. They (the security company) are bringing in 25 persons. <br />Diamonds is also asking for Ramsey Police assistance in getting out to Highway #10, etc. <br />He understood having to pay for the Police services from 9:30 to 10:30, for example, but <br />not for the entire event. He felt that would be unnecessary. He was in agreement with <br />negotiating something on that order and working with Chief Gustafson. Mr. Gruber <br />noted that all outdoor liquor sales shall cease and it appears that this includes his patio. <br />He commented that a lot of people like to sit on the patio and that it is normally open <br />until 12:30 - 1:00 a.m. He stated that after everything settles down and things are back to <br />adults only present, he wondered if he could then use his patio again. He understood that <br />sales on the patio should stop for an hour or so. With regard to parking, Mr. Gruber <br />suggested that they could accommodate 1,700 cars. With regard to people under 21, he <br />reported that there would be bracelets identifying those 21 and over. <br /> <br />City Attorney Goodrich suggested that if the City allows parking in the easement, then <br />The Diamond's insurance must also cover this area and that they would hold harmless the <br />City from any liability. <br /> <br />Mr. Gruber responded that they have no problem with that. <br /> <br />City Council/May 11, 1999 <br />Page 11 of 18 <br /> <br /> <br />
