Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />adopt Resolution #99-05-094 approving the issuance of a home occupation permit based <br />on Findings of Fact #0493 and declaring terms of permit for a commercial cattery. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />Case #5: <br /> <br />Request for a Conditional Use Permit to Exceed the Total Amount of <br />Accessory Building Space and the Single Building Size Restriction on <br />a Parcel; Case of William Rome <br /> <br />Zoning Administrator Frolik stated that on April 16, 1999, the City received an <br />application from William and Judith Rome for a conditional use permit to exceed the <br />total amount of accessory building space and the single building size restrictions on their <br />property at 16100 Dysprosium Street NW. Mr. Rome is proposing to construct a 2,400 <br />square foot accessory building to provide indoor storage of personal equipment and <br />vehicles. His property is 3.3 acres in size and City Code allows a total of 2,464 square <br />feet of garage and accessory building space on the property; and no single building <br />should exceed 1,600 square feet in size. He currently has a 986 square foot garage. This <br />leaves him with a remaining accessory structure space allotment of 1,478 square feet. <br />His proposal for a new accessory building results in an 800 square foot overage in the <br />single building size restriction and 922 square foot overage in the total amount of garage <br />and accessory building space allowed on the property. The exterior finish is proposed to <br />be colored metal to match the home. Code also requires that the building be designed <br />with soffit, fascia and eave overhang. Ms. Frolik pointed out that this property is zoned <br />rural residential and is not anticipated to be included in the Metropolitan Urban Service <br />Area in the near future. She noted that City Council is in the process of amending the <br />City Code to eliminate the single building size restriction. In the past, Council has taken <br />action that would encourage property owners to store their vehicles and equipment <br />indoors. Ms. Frolik reported that the Planning Commission conducted a public hearing <br />on May 4, and received one written submittal from the Boy Scout Camp opposing the <br />request, stating that the building would diminish the wilderness environment. It was <br />noted that the subject property is heavily forested and the building will be no closer to the <br />scout camp property line than Mr. Rome's home. The Planning Commission <br />recommended approval. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Resolution #99~05-095 adopting Findings of Fact//0494 relating to a request from <br />William and Judith Rome for a conditional use permit for an overage in the accessory <br />building size restriction and the total amount of accessory building space allowed on a <br />parcel of land. <br /> <br />Motion carried.
