Voting No: None. <br /> <br />Case #4: Request for a Home Occupation Permit; Case of Bonita Cobey <br /> <br />Zoning Administrator Frolik reported that the City received an application from Bonita <br />Cobey for a home occupation permit to establish a cattery in her home at 9340 Highway <br />#10 NW. The property is zoned B-1 Business but is subject to residential zoning <br />regulations because the principal use of the property is residential. The adjacent property <br />to the east is State Wayside Park and the property to the west and on the north side of <br />Highway #10 is also zoned B-1 Business. Ms. Frolik explained that Ms. Cobey raises <br />and sells Persian and Himalayan cats. She (Cobey) is proposing to establish a cattery in <br />her home for a maximum of 24 cats, 16 weeks of age and older. Ms. Cobey states that <br />this is an indoor operation and the cages are constructed of laminated wood, pvc pipe and <br />vinyl coated wire. The cages have automatic watering systems with computer controlled <br />timing and food is gravity fed. The cattery room is also equipped with controlled <br />heating, ventilation, air purifier and vinyl flooring. Ms. Cobey has been informed by the <br />Humane Society that there are no special requirements for disposing of the cat excrement <br />and she disposes of it in her household garbage. Ms. Frolik continued that City Code <br />restricts home occupations to 20 percent of the gross floor area of the home, or in Ms. <br />Cobey's case, 920 square feet. The rooms in which the home occupation will be <br />conducted total 350 square feet. She has stated that she will be the sole employee and she <br />doesn't expect that there would ever be more than two customers on her property at any <br />given time. Her driveway is sufficient in length to provide off-street parking. Ms. Cobey <br />has applied for certification from the Cat Fanciers' Association (CFA) which requires a <br />rigid annual inspection. This year's inspection was recently performed by DVM Mark <br />Guck of the Rum River Veterinary Clinic and he has provided a report for Council's <br />information. Ms. Cobey has also provided statements of support for her request from an <br />area resident and Dr. Guck. Ms. Frolik advised that the Planning Commission conducted <br />a public hearing on May 4, and there were no additional written or verbal comments <br />submitted at the hearing. The Planning Commission recommended approval of the <br />request. Although City Code does not generally allow for signage of home occupations, <br />the Planning Commission did draft Ms. Cobey's permit to allow for a business <br />identification sign because her property is legally zoned commercial and is in the midst of <br />a commercial district on Highway #10. She noted that Ms. Cobey is present. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />adopt Resolution #99-05-093 adopting Findings of Fact #0493 relating to a request from <br />Dennis and Bonita Cobey for a home occupation permit for a commercial cattery. <br /> <br />Motion carried.
