Public Hearing <br /> <br />Presentation <br /> <br />Zoning Administrator Frolik explained that Michael Gobernatz resides at 5900 - 177th <br />Avenue NW and is proposing to add a detached garage to his property. Because of the <br />sharp declines in topography in the rear yard, the most logical location for the new <br />detached garage is between the home and the west property line. The side yard setback <br />from the west property line is l0 feet, which is equal to a 10-foot drainage and utility <br />easement along the west property line. The farthest Mr. Gobernatz can set the garage <br />from the west property line is five or six feet. In accordance with City Code, he has made <br />application to the Board of Adjustment for a five-foot variance to the 10-foot side yard <br />setback. If granted, the variance is of no value unless at least five feet of the drainage and <br />utility easement is vacated. The standard drainage and utility easement along common <br />property lines is five feet. In reviewing Mr. Gobernatz' 10-foot easement on the west <br />property, City staff has determined that there was no particular reason that 10 feet was <br />dedicated on the plat. Staff is assuming that the plat was drawn with 10-foot easements <br />and because there is a 10-foot structure setback, it probably wasn't cost effective to have <br />the final plat mylars redrawn to reduce the drainage easement to five feet. Ms. Frolik <br />stated that staff is recommending approval of the request for easement vacation. She <br />added that Mr. Gobematz wants it noted on record that he is present at the public heating. <br /> <br />Citizen Input <br /> <br />None <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to <br />close the public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman <br />and Anderson. Voting No: None. <br /> <br />The public hearing adjoumed at 7:15 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:15 p.m. <br /> <br />Councilmember Zimmerman commented that in the rural area, we do not have as much <br />congestion and we could get by with five feet. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to <br />introduce an ordinance to vacate a portion of the drainage and utility easement on Lot 2, <br />Block 1, Gobematz Addition. <br /> <br />City Council/May 25, 1999 <br /> Page 5 of 25 <br /> <br /> <br />
