Voting Yes: Mayor Gamec Councilmembers Anderson, Hendriksen, and <br />Zimmerman. Voting No. None. <br /> <br />Case #2: <br /> <br />Adopt Ordinance to Vacate Drainage and Utility Easement; Case of Michael <br />Gobernatz <br /> <br />Zoning Administrator Frolik stated that Michael Gobematz resides at 5900 - 177t~ Avenue NW <br />and is proposing to add a detached garage to his property. Because of sharp declines in <br />topography in the rear yard, the most logical location for the new detached garage is between the <br />home and west property line. Ms. Frolik explained that the side yard setback from the west <br />property line is ten feet, which is equal to a ten-foot drainage and utility easement along the west <br />property line. The farthest Mr. Gobernatz can set the garage from the west property line is six <br />feet. In accordance with City Code, he made application to the Board of Adjustment and, on <br />June 1, 1999, received a four-foot variance to the ten-foot side yard setback. She stated that Mr. <br />Gobematz still cannot build the garage six feet from the west property line unless City Council <br />adopts the ordinance that was introduced on May 25, 1999, to vacate five feet of the ten-foot <br />drainage and utility easement. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Zimmerman to adopt <br />Ordinance #99-07 to vacate a portion of the drainage and utility easement on Lot 2, Block 1, <br />Gobematz Addition. <br /> <br />A roll call vote was performed by Mayor Gamec. <br /> <br />Councilmember Hendriksen aye <br />Councilmember Anderson aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />City Council/June 8, 1999 <br />Page 4 of 16 <br /> <br /> <br />
