CASE # <br /> <br />CONSIDER MODIFICATION TO SWEETBAY RIDGE CONDITIONS FOR FINAL <br />PLAT APPLICATION; CASE OF OAKWOOD LAND DEVELOPMENT <br /> By: Asst. Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Sweetbay Ridge received preliminary plat approval on August 23, 2005. One condition of the pre 'taninary <br />plat approval was that the Developer could not subrrdt an application for tirol plat approval until MPCA <br />issues a Certificate of Completion for the site clean up. Site clean-up is anticipated to be complete in mid- <br />June, with the completion report being submitted to MPCA by June 30. Because of workload and ~fl~ng <br />constraints, MPCA estimates that a Certificate of Completion may take up to 60 days to process. This <br />could mean that the Developer could not even submit the application for final plat until the end of August <br /> <br />Observations: <br /> <br />The Developer is hoping to be able to commence construction of model homes in Brookfield <br />before the end of the year. The installation of sewer and Water main improvements through <br />Sweetbay is critical to issuance of building permits in Brookfield, since adequate fire protection <br />would not be available in Brookfield without the watermain looping. <br /> <br />If the Developer can't even apply for final plat approval until the end of August, model home <br />construction will not be feasible before the end of the year. The Developer is requesting that the <br />City Council allow City Staff to accept and process the final plat application prior to receipt of <br />MPCA's Certificate of Completion. If so, final plat approval would be presented to City Council at the <br />end of July or the first meeting in August. It is anticipated that the MPCA Certificate of Completion will be <br />available sometime in August also. In this way, it is conceivable that grading and installation of <br />improvements could occur this season. <br /> <br />At the City Council Work Session on June 6, the City Council indicated that processing the final plat <br />simullaneously with MPCA's review of the soil remediation report would be acceptable. <br /> <br />Recommendation: <br /> <br />City Staff is recommending that City Council take formal action to allow the Developer to <br />submit the final plat application for Sweetbay. <br /> <br />Council Action: <br /> <br />Motion by Councilmember and seconded by C0uncilmember to modify the <br />August 23, 2005 conditions applied to the Sweetbay Ridge preliminary plat and allow for <br />submittal of the final plat application prior to MPCA issuing a Certificate of Completion for soil <br />remediation activity on the Subject Property. <br /> <br />Review Checklist: <br />City Engineer <br />Community Development Director <br /> <br />CC: 06.13.06 <br /> <br />q <br /> <br />-237- <br /> <br /> <br />
