It has been determined by the City Attorney that the City has the <br />ability to continue to use this area as a public road since we have been maintaining it as road for many <br />years. The City Council has authorized the use of' eminent domain to purchase additional land needed <br />for the use as Potassium St. Staff and City representatives have been in contact with the property owners <br />affected by the Potassium St. project and a public purpose hearing for proceeding will take place on June <br />23, 2006. <br /> <br />On June 14, 2005 the City Council took action to approve the preliminary plat contingent on the <br />following items: <br /> <br /> 1. Compliance with City StaffReview Letter dated May 6, 2005 <br />2. The City having acquired marketable title to a permanent easement for public street and utility <br /> purposes over and across the east 46 feet of the northwest quarter of the northeast quarter, Section 23 <br /> Township 32 Range 25, Anoka County lying north of County State Aid Highway No. 5. <br />3.
