Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #06-06~ A RESOLUTION GRANTING CONTINGENT FINAL PLAT APPROVAL OF SHADE TREE COTTAGES. WHEREAS, Shade Tree Communities, LLC, hereinafter referred to as "Applicant", has properly applied for preliminary plat approval of Shade Tree Cottages on the following described property located in the City of Ramsey: All that part of the Northeast Quarter of the Northwest Quarter of Section 23, township 32,. Range 25, lying east of the easterly right-of-way of County State Aid Highway No.5, Anoka County, Minneso. ta. (the "Subject Property") WHEREAS, on November 20, 2004, the City of Ramsey received an application and sketch plan from Shade Tree Communities, LLC, for a plat to be named Shade Tree Cottages (the Plat); and WHEREAS, on January 6, 2005, the Planning Commission reviewed the sketch plan for the Plat; and WltEREAS, on January 25, 2005 and February 22, 2005, the City Council reviewed the sketch plan for the Plat; and WHEREAS, on March I5, 2005, the Developer submitted a preliminary plat for the Plat to the City for consideration; and WHEREAS, on April 7, 2005, the Planning Commission conducted a public hearing and recommended the City Council deny the preliminary plat of the Plat; and WHEREAS, on April 14, 2005, the Park mad Recreation Commission recommended park dedication and trail fees for the Plat be satisfied through a cash payment; and WHEREAS, the primary access to the Plat is to be via Potassium Street NW lying to the east of the Plat; and WHEREAS, Potassium Street is dedicated to the City by statutory dedication as a result of it having been in continuous public use and maintained by the City over a six year period; and -266-
