WHEREAS, the right of way for Potassium Street is a statutory dedicated street varies in <br />width from approximately 40 feet to 46 feet and its location severs the properties lying to the <br />east; and <br /> <br /> WHEREAS, the City requires a minimum of 60 feet for urban streets such as Potassium <br />Street; and <br /> <br />WHEREAS, 14 feet of the necessary right of way can be dedicated within the Plat; and <br /> <br /> WHEREAS, the balance of the 60 foot right of way or 46 feet needs to be acquired from <br />the properties lying east of the Plat; and <br /> <br /> WHEREAS, on May 10, 2005, May 24, 2005, and June 14, 2005 the City Council <br />reviewed the preliminary plat for the Plat; and <br /> <br /> WHEREAS, on June 14, 2005 the City Council. gave contingent preliminary plat <br />approval the development of Shadetree Cottages contingent on the following items <br /> <br />1. Compliance with City Staff Review Letter dated May 6, 2005 <br /> <br />¸2. <br /> <br />The City having acquired marketable title to a permanent easement for <br />public street and utility purposes over and across the east 46 feet of the <br />northwest quarter of the northeast quarter, Section 23 Township 32 Range <br />25, Anoka County lying north of County State Aid Highway No. 5. <br /> <br />The City having acquired marketable title to a permanent easement for <br />public street and utility purposes over and across the east 46 feet of the <br />northwest quarter of the northeast quarter, Section 23 Township 32 Range <br />25, Anoka County lying north of County State Aid Highway No. 5.; and <br /> <br /> WHEREAS, on July 26, 2005, the City Council amended the contingent preliminary plat <br />approval by adding the following contingency: <br /> <br />City staff shall undertake the following tasks in order to address <br />transportation needs in the area of Nowthen Boulevard (CSAH), Old <br />Nowthen, Potassium Street and Alpine Drive. <br /> a. Keep the new Potassium Street road alignment as far west as <br /> possible and construct it to 24' (curb to curb) in width, with the <br /> west side curb to be concrete and the east side to be bituminous <br /> curb. <br /> b. Require the establisbanent of a temporary public road access <br /> from Quicksilver Circle to CSAH #5 through the Shade Tree <br /> Cottages development conditioned on the affected property <br /> owners on Potassium Street agreeing in writing to convey the <br /> <br />RESOLUTION #06~06- Page 2 of 3 <br /> -267- <br /> <br /> <br />
