Case #1:

Adopt Ordinance to Vacate Drainage and Utility Easement in A.E.C. Energy
Park; Case of Direct Enclosures

Zoning Administrator Frolik stated that during site plan review for the new Direct Enclosures
facility in A.E.C. Energy Park, it was noted that the building pad is encumbered with a drainage
and utility easement. The purpose of the easement was to protect the wetland as defined on the
A.E.C. plat. As a result of the Direct Enclosures permit from the Lower Rum River Water
Management Organization, a wetland mitigation replacement plan has been approved on the
adjacent parcel to the east. Therefore, the wetland area on the Direct Enclosures parcel is being
filled and the City can release the easement. Since the City owns the adjacent property to the
east, north and west, there is no need for the standard drainage and utility easements around the
perimeter of the Direct Enclosures lot and they also are proposed to be vacated. Direct
Enclosures is also dedicating a utility easement across the southeast comer of their lot to
accommodate the storm sewer.

Councilmember Zimmerman inquired if the City has a full easement along Sunwood Drive.

Zoning Administrator Frolik replied yes.

Motion by Councilmember Anderson, seconded by Councilmember Connolly, to adopt
Ordinance #99-10 to vacate certain drainage and utility easements on Lot 1, Block 2, A.E.C.
Energy Park.

A roll call vote was preformed by the Recording Secretary.

Councilmember Hendriksen aye
Councilmember Anderson aye
Councilmember Connolly aye
Councilmember Zimmerman aye
Mayor Gamec aye

Motion carried.

Case #2:

Adopt Ordinance to Vacate a Part of McKinley Street NW; Case of City of
Ramsey

Zoning Administrator Frolik stated that the eastern terminus of McKinley Street is platted as a
cul-de-sac. Continued development of Business Park 95 by the City of Ramsey required
extending Radium Street north off of McKinley. That extension occurred at the location of the
cul-de-sac bulb and, therefore, a vacation of that bulb right-of-way is required.

City Council/August 24, 1999
