5) Authorize Vendor for Resurfacing of River's Bend park Tennis Courts <br /> <br />This item was tabled. <br /> <br />Case #7a: Orrin Thompson Homes Update <br /> <br />Director of Public Works/Fire Chief Kapler stated that a letter was sent from staff to Orin <br />Thompson Homes suspending all additional building permits or platting effective September 20, <br />1999, until the grading problem is resolved. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Connolly, ratifying staffs <br />letter suspending all additional building permits or platting effective September 20, 1999. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Connolly, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Case #7b: Barium Street Update <br /> <br />Councilmember Zimmerman stated that there is a serious erosion problems at a residence located <br />on Barium Street and that there is an urgency to resolve the problem. There is a need for action <br />to resolve the problem, which might include locating the City's easement specifically, asking <br />questions as to who is responsible for the problem (builder, design engineer of the plat), and <br />directing staff to find out some of the answers and the course of action. <br /> <br />Mayor Gamec questioned if the City gets involved is the City liable for any future problems. <br /> <br />City Attorney Goodrich replied that if the City takes on the project they need to do it correctly <br />and the project would also have to have a public purpose in regards to paying for the project. <br />The City would also need the cooperation from the homeowner to complete the project. <br /> <br />Councilmember Anderson questioned the health and safety factor of the project. <br /> <br />Councilmember Zimmerman replied the house could fall into the City drainage easement. <br /> <br />Councilmember Anderson noted that one thing that might be helpful is the Board of Soil and <br />Water can make matching grants with erosion problems on private property. She questioned <br />what the City can do in the future to prevent the problem from happening again. <br /> <br />Councilmember Connolly stated that the City needs to have a policy in regards to certain slope <br />degree. <br /> <br />City Council/September 14, 1999 <br /> Page 21 of 23 <br /> <br /> <br />
