Councilmember Hendricksen questioned if Zitco is willing to pay for their drainage.

Lowell Zitzloff stated that he is willing to pay for any drainage that needs to be done on his
property and that each property owner has an obligation to take care of their own drainage.

Mayor Gamec questioned if all of the businesses were to attach to the pipe for drainage into the
pond, would the pond have enough capacity to hold the water.

City Engineer Jankowski replied that the pond should have adequate capacity.

Councilmember Anderson questioned if there would be more than one way to finance the
project.

City Attorney Goodrich explained that it could be a special assessment project, but noted that
businesses could opt out of the project. The other option would be to adopt an ordinance that
would have a license fee to defray the cost of the storm water system without proving benefit. A
charge would be made similar to a utility charge.

Councilmember Hendriksen questioned if they went the 444 process, would the Mississippi
District be assessed.

City Attorney Goodrich replied that it is his understanding that the City could develop a sub-
district to help defray the cost.

Councilmember Hendriksen stated that there should be one district for crossing the railroad track
on the north side of Highway #10 and then a larger district to cover the cost of draining the pond
to the river.

City Attorney Goodrich replied that they should be able to accomplish the districts with 444. He
stated that the Council should have detailed information as to how 444 would work before the
applications are approved.

Community Development Director Sherman stated that she was concerned over the 60-day
requirement.

Mt'. Zitzloff replied that time is becoming an element, but is willing to wait another couple of
weeks to resolve the problems.

City Attorney Goodrich stated that he wants to make sure they follow the right legal procedures.

City Engineer Jankowski stated the difference between Mr. Zitzloff taking care of his own
drainage problem and planning for the future is upsizing the pipe.

City Council/September 28, 1999
