situation and look into the idea of adding on to his existing garage to house the vehicle. City
Staff agreed to a six month extension with certain time frames that have to be met.

City Attorney Goodrich noted that Council has the authority to change the amount of time he is
allowed to correct the situation.

Community Development Sherman stated that what the resident is doing is a violation, but
explained that it has been the direction in the past to try and work with the resident to correct a
situation.

Counciimember Hendriksen questioned if the garage addition is feasible for the property.

Community Development Director Sherman explained that his plans are to modify the attached
garage working with the builder of his home. No plans have been received by the City as of yet,
but they have a deadline of October 15t~' to submit the plans. If they cannot come in with a plan
to comply with City Code then they will be forced to remove the vehicle.

Councilmember Hendriksen stated that it seems that the City is right on track, and suggested that
they should wait until October 15'~' to determine if the project can be accomplished.

City Attorney Goodrich requested of the Community Development Assistant that the Council
would like to review any plans submitted.

Mayor Gamec questioned if the truck would have to be removed if they cannot put together a
plan on October 1

Community Development Director Sherman replied yes.

Councihnember Zimmerman stated that he is inclined to work with the person to correct the
problem.

Mr. Green stated what about the other residents who are being woken up at 3:00 in the morning.

City Attorney Goodrich replied that it has not been established that the truck is completely
illegal.

Mr. Green responded that the truck is not covered 75 percent in the driveway and the process to
have the truck removed began in May and now it is almost October and nothing has been done.

Councilmember Hendriksen replied that a decision will be made in October. If the proposed
addition meets all of the zoning ordinances, then the project would be acceptable.

Mr. Green stated that in his opinion the appropriate garage could not be constructed on the
property without distorting the neighborhood.

City Council/September 28, 1999
