home on Lot 9, Block 1, by On'in Thompson, which was two feet lower than the approved grading plan. An alternative grading plan was presented by On-in Thompson on October 7, 1999. The plan was reviewed by both Staff and an independent consultant and found to be both deficient and incomplete. The Committee asked that 1) Orrin Thompson be requested to resubmit a plan correcting the deficiencies and omission; 2) That this information be reviewed by an independent engineer, Hakanson Anderson Associates; and 3) That no building permits be allowed until a revised plan has been approved and an escrow had been deposited with the City in the amount of 150% of the estimated construction cost of the remedial work. Director of Public Works Kapler noted that he spoke to Bill Pritchard of Orrin Thompson Homes and explained that they are in the process of revising the plan and will meet with the affected homeowner this week. They requested that the City pursue information as to what the cost of the project will be so that they can forward a letter of credit or money for escrow. Councilmember Zimmerman requested that the residents be invited to attend the next Public Works Committee meeting as well as a representative of Orrin Thompson Homes. Councilmember Hendriksen stated that there are two very serious issues with the development, including what he refers to as the "crater". He thinks the City has justification for withholding building permits and questioned if the way the property sits is what is included in the mining and grading permit. Director of Public Works Kapler replied that City Engineer Jankowski has not been able to review the mining and grading permit. He suggested bringing in Hakanson Anderson as an outside opinion to determine how much it exceeds the mining and grading permit. Councilmember Hendriksen replied that Mr. Kapler's suggestion was a great idea because the City needs to be prepared to defend the decision if they decide to deny the petition based on past performance. Councilmember Connolly noted that the Committee requested that a snow fence be placed around the area for safety reasons. 3) Consider Acquisition of Right-of-Way for Barium Street Extension from Willow Ridge to 153r'~ Avenue Councilmember Zimmerman stated that the discussion of the fight-of-way for Barium Street extension from Willow Ridge to 153~d Avenue was promoted by a letter from Rademacher Companies. The Committee suggested that Staff meet with Rademacher to discuss their expectations for compensation, as well as ancillary issues as the use of the severed 0.9-acre parcel, which would be created east of the Barium Street extension.
