5. That the applicant is proposing to redevelop the subject property. <br />6. The applicant has applied for minor subdivision and site plan approval for the subject <br />property. <br />7. That the applicant is proposing to divide the subject property into two lots with one lot <br />containing a convenience gas station and the other lot containing a retail center building. <br />8. That approximately 48,300 square feet of the Subject Property is located in the <br />Mississippi Critical River Overlay District and the Wild and Scenic River Overlay <br />District. <br />9. That the current business operating on the subject property has 100% impervious surface <br />lot coverage on that part of the property that is within the Critical River and Wild and <br />Scenic River Overlay District. <br />10. That the proposed new development on the subject property is showing only 69% of <br />impervious lot coverage on that part of the property that is within the Critical River and <br />Wild and Scenic River Overlay District. <br />11. That Section 9.21.07(1)(b) (Critical River Overlay District Development Standards), and <br />• <br />Section 9.23.06(1) (Scenic River Overlay District Development Standards) establishes <br />the maximum impervious surface area allowed of 30% of the total lot area. <br />12. That the 30% impervious surface restriction is designed to limit site runoff to the <br />Mississippi River. <br />13. That the subject property is approximately a quarter mile from the Mississippi River and <br />is located north of State Highway 10. <br />14. That the Subject Property is the only piece of land within the Critical River and Wild and <br />Scenic River Overlay District that is located north of State Highway 10. <br />15. That the Applicant will be providing on -site storage and treatment of site run -off. <br />16. That similar variances have been granted in the past. <br />17. That there are unique circumstances applying to the subject proposal, namely: a) the <br />subject property is one quarter mile from the Mississippi River and is north of State <br />Highway 10; and b) the subject property is currently developed and already exceeds the <br />maximum impervious surface lot coverage for the Critical River and Wild and Scenic <br />River Overlay District; <br />RESOLUTION #01 -04 -170 <br />Page 2 of 4 <br />
