• <br />18. That the special conditions causing the undue hardship and the inclusion of a parcel of <br />land north of State Highway 10 in the Critical River and Wild and Scenic River Overlay <br />District, did not result from the actions of the Applicant. <br />19. That if denied, the Applicant will be deprived of developing the subject property in a <br />manner consistent with what is already on the property and in a manner consistent with <br />the adjacent properties <br />20. That if granted, the variance will not grant the Applicant any special privilege that is <br />denied to other owners of lands, structures or buildings in the same district. <br />21. That if granted, the variance will not impair an adequate supply of light and air to <br />adjacent property. <br />22. That if granted, the variance will not be materially detrimental to the purposes of the <br />Ramsey Zoning Chapter or other property in the B -3 Highway Business District the <br />Critical River Overlay District, and the Wild and Scenic River Overlay District. <br />23. That if granted, the variance will not substantially increase the congestion of public <br />streets, or increase the danger of fire, or endanger the public safety, or substantially <br />impair property values within the neighborhood. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Kociscak <br />Board Member Watson <br />Board Member Reeve <br />Board Member Wivoda <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Board Member Johnson <br />RESOLUTION #01 -04 -170 <br />Page 3 of 4 <br />
