• <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -216 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0554 RELATING TO A REQUEST <br />FROM KARL AND BETH VIRKUS FOR A VARIANCE TO ENCROACH FIVE FEET <br />INTO THE REAR YARD SETBACK ON THE PROPERTY LOCATED AT 16940 <br />AZURITE STREET. <br />WHEREAS, Karl and Beth Virkus, hereinafter referred to as "Applicants," have properly <br />applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey City Code to <br />construct a home addition that encroaches five feet into the rear yard setback on the property <br />generally known as 16940 Azurite Street NW and legally described as follows: <br />Lot 4, Block 4, Shady Lawn Estates, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on June 5, 2001, and that said public hearing <br />was properly advertised, and that the minutes of said public hearing are hereby incorporated <br />as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Rural Residential and is approximately 1.3 acres in <br />size. <br />3. That the Subject Property is surrounded by R -1 Rural Residential zoning. <br />4. That Section 9.20.11 of the Ramsey City Code requires a 35 -foot rear yard setback. <br />5. That when the house was constructed the City's policy was to have houses built to one side <br />of the subject property in order to retain options for resubdivision. The Applicant's house <br />was constructed along the very northern edge of the Subject Property and therefore further <br />restricts the home addition to the north. <br />6. That the location of the well limits the construction of a home addition to the south. <br />7. That the existing vegetation and drainage areas located to the south of the principal <br />structure limits the location of a detached accessory building and does not provide for the <br />Applicant's space needs. <br />
