Councilmember Kurak introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -06 -240 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0562 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT <br />WHEREAS, on May 23, 2001, St. Paul Terminals Metal Express, hereinafter referred to <br />as Applicant, has properly applied for a conditional use permit to operate a recycling and <br />processing facility for metals and landscape timbers on the property generally known as 14050 <br />Basalt Street N.W. and legally described as follows: <br />Lot 1 and Lot 2 (except the south 30 feet of Lot 2), Block 4, Gateway North Industrial <br />Park Plat 2, Anoka County, Minnesota. <br />(the " Subject Property") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning and Zoning Commission for a public <br />hearing pursuant to Section 9.03.04 of the Ramsey City Code on June 5, 2001, and that <br />said public hearing was properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br />2. That the subject property is approximately 2.4 acres in size. <br />3. That the subject property is located in the Industrial District. <br />• 4. That the adjacent parcels to the north, east and south are also zoned Industrial and the <br />adjacent parcel to the west is zoned Business Warehouse and is occupied with an asphalt <br />production plant, a heavy industrial user. <br />5. That on April 25, 1989, the City of Ramsey issued a conditional use permit to Daniel <br />Karst to operate an aluminum processing facility on Lot 1, Block 4, Gateway North <br />Industrial park Plat 2. <br />6. That on November 13, 1990, the City Council approved an amendment to the Conditional <br />Use Permit to expand the use to include a second melt furnace. <br />7. That on March 9, 1993, the City Council approved an amendment to the Conditional Use <br />Permit to allow the disassembly of engines and transmissions as part of the preparation of <br />feedstock for the aluminum melt furnaces, and the said Conditional Use Permit was <br />issued to Danny's Aluminum Processing, Inc. ( "Danny's Inc.") <br />8. That the City records indicate a significant history of violations of the terms of the <br />conditional use permit issued to Danny's Inc. <br />9. That in 1999, St. Paul Terminals assumed the responsibility of managing the facility and <br />entered into a lease /purchase option with Mr. Daniel Karst and/or Danny's Inc. <br />10. That since St. Paul Terminals commenced managing the facility, there has been a <br />significant improvement in the condition of premises. <br />11. That Daniel Karst and representatives of St. Paul Terminals advise the City that City <br />• <br />reassignment of the conditional use permit from Danny's Inc. to St. Paul Terminals is one <br />of the criteria for the completion of the lease /purchase agreement with St. Paul Terminals. <br />
