<br />. <br /> <br />MA YOR AND COUNCIL INPUT <br /> <br />1) Update on Apple Ridge <br /> <br />City Attorney Goodrich stated that US. Homes has signed an agreement with the Weiss's and <br />requested that Council consider issuing building permits once a $45,000 letter of credit is <br />received by US. Homes to cover administrative costs and after receiving access to other affected <br />property owners. <br /> <br />Councilmember Hendriksen stated that there was some discussion during the Public Works <br />Committee in regards to the situation. Three affected homeowners were present with one stating <br />they had constructed a retaining wall at their own cost that will now need to be removed and he <br />thinks there needs to be agreements with all ofthe homeowners. <br /> <br />Mayor Gamec stated that if the City allows building permits to be issued contingent upon all <br />agreements being made with the property owners it would be acceptable. <br /> <br />City Attorney Goodrich noted that he is concerned that delaying the issuing of building permits <br />will expose the City to some liability. The $45,000 letter of credit gives US. Homes initiative to <br />resolve issues with the other homeowners. <br /> <br />. Councilmember Connolly stated that she is concerned that the other affected property owners are <br />reimbursed for landscaping costs they have already incurred. <br /> <br />Councilmember Anderson inquired if US. Homes has an obligation to the other property <br />owners. <br /> <br />City Attorney Goodrich replied yes as well as the City. <br /> <br />Councilmember Connolly stated that she would be more comfortable with a$60,000 letter of <br />credi t. <br /> <br />Councilmember Anderson also felt the amount should be increased. <br /> <br />Councilmember Hendriksen stated that he is concerned that the amount of money being set too <br />low that the builder will pay the amount in order to get building permits and not move forward <br />with the project. He requested that a time frame be placed on issuing building permits to make <br />sure the work is completed. <br /> <br />. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to commence <br />issuing permits to U.S. Homes and consider subdivisions with a deposit or letter of credit in the <br />amount of $60,000. In the event that US. Homes has not received the necessary approval as <br />determined by the City attorney by February 1, 2000, the City will stop considering building <br /> <br />City Council/December 21,1999 <br />Page 14 of 15 <br />
