Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01- 08 -258A <br />RESOLUTION ADOPTING FINDINGS OF FACT #0565 RELATING TO A REQUEST <br />FROM ROBERT A. AND LINDA S. STATON FOR VARIANCE TO CONSTRUCT AN <br />ACCESSORY STRUCTURE NEARER THE FRONT PROPERTY LINE THAN THE <br />PRINCIPAL STRUCTURE <br />WHEREAS, Robert and Linda Staton, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 9.11.02 of the Ramsey City <br />Code to construct an accessory structure nearer the front property line than the principal structure <br />on the property generally known as 14620 Bowers Drive NW and legally described as follows: <br />Lot 16, Bower's Mississippi Acres, Anoka County, Minnesota <br />(the "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on August 7, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1 Rural Residential and is approximately 36,280 <br />square feet or .83 acres in size. <br />3. That the Subject Property is surrounded by R -1 Rural Residential zoning. <br />4. That Section 9.11.02 of the Ramsey City Code does not permit the construction of <br />accessory structures nearer the front property line than the principal structure. <br />5. That Section 9.21 of City Code establishes a structure setback of 200 feet from the <br />Ordinary High Water (OHW) mark of the Mississippi River. <br />6. That the principal structure (dwelling) on the Subject Property is located approximately 214 <br />feet from the front property line and 100 feet from the OHW mark of the Mississippi River. <br />7. That the Applicant is proposing to place a 16' x 28' accessory structure on the Subject <br />property that will be located approximately 48 feet from the front property line and 276 feet <br />from the OHW mark of the Mississippi River. <br />8. That if the accessory structure were to be constructed in the rear yard (between the home <br />and the river), it would encroach on the 200 foot setback from the Mississippi River <br />ordinary high water mark. <br />9. That similar variances have been granted in the R -1 Rural Residential District in the City of <br />Ramsey generally, and specifically on Bowers Drive. <br />
