• <br />10. That the total amount of existing accessory structure space (1040 square feet) and proposed <br />amount of accessory structure space (448 square feet) totals 1,488 square feet, which is the <br />maximum amount of accessory structure space allowed on the Subject Property. <br />11. That the Mississippi River setback requirement imposes a hardship on the Subject Property <br />that is not applicable to other lands in the same district. <br />12. That the variance requested is the minimum variance necessary to accomplish the intended <br />purpose of the Applicant without impacting the on -site septic system, minimizing <br />destruction of mature trees, and complying with the setback from the Mississippi River <br />Ordinary High Water mark. <br />13. That the unique circumstances on the Subject Property do not result from the actions of the <br />Applicant. <br />14. That, if granted, the variance will not increase the congestion in the public street. <br />15. That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br />16. That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br />17. That, if granted, the variance will not grant the Applicant any special privilege that is <br />denied to the owners of other land in the same district. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Vice Chair Kociscak <br />Board Member Johnson <br />Board Member Watson <br />Board Member Reeve <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Chairperson Nixt <br />Board Member Sweet <br />RESOLUTION #01- 08 -258A <br />Page 2 of 3 <br />
