Councilmember Hendriksen introduced the following resolution and moved for its adoption: RESOLUTION #01 -09 -360 A RESOLUTION ADOPTING FINDINGS OF FACT #0574 RELATING TO A REQUEST FROM BRADLEY WOLF FOR A CONDITIONAL USE PERMIT TO EXCEED THE MAXIMUM ACCESSORY STRUCTURE SQUARE FOOTAGE RESTRICTIONS ALLOWED ON APPROXIMATELY 53 ACRES. WHEREAS, Bradley Wolf, hereinafter referred to as the "Applicant," has properly applied for a Conditional Use Permit to exceed the maximum square footage restrictions established in City Code on the property generally known as 6421 Green Valley Road and legally described as follows: Parcel 1: All that part of the East One -Half of the Northeast Quarter of Section 3, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at the Southwest corner of said East One -Half of the Northeast Quarter; thence South 89 degrees 46 minutes 24 seconds East (assumed bearing) along the South line of said East One -Half of the Northeast Quarter to the West line of the East 658.05 feet of the West 60 acres of said East One -Half of the Northeast Quarter; thence North 0 degrees 50 minutes 22 seconds East along said West line of the East 658.05 feet of the West 60 acres of said East One -Half of the Northeast Quarter for a distance of 817.76 feet, said point being the actual point of beginning of the tract of land to be described; thence North 34 degrees 21 minutes 17 seconds West for a distance of 146.64 feet; thence North 21 degrees 29 minutes 00 seconds West for a distance of 111.06 feet; thence South 88 degrees 06 minutes 00 seconds West for a distance of 202.11 feet to the West line of said East One- Half of the Northeast Quarter; thence Northerly along said West line, to the Northwest corner of said East One -Half of the Northeast Quarter; thence Easterly along the North line of said East One -Half of the Northeast Quarter to the West line of the East 658.05 feet of the West 60 acres of said East One -Half of the Northeast Quarter, thence South to the point of beginning. Parcel 2: The East 658.05 feet of the West 60 acres of the East Half of the Northeast Quarter, Section 3, Township 32, Range 25, Anoka County, Minnesota. Our File No.: 91 -5215 ( "Subject Property ") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 1. That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on September 4, 2001, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That the Subject Property is approximately 53 acres in size.
