Mayor Gamec asked why the' City is even involved in this. <br /> <br />Mr. Goodrich replied because we were concerned about this being a poor drainage plan. <br /> <br />Mr. Kapler commented that we physically would have to lift this house up in order for it to be a <br />walkout. We have asked for a drainage plan that would be acceptable. <br /> <br />Councilmember Hendriksen suggested calling the adjacent neighbors to see if they do not want <br />of if they want a retaining wall in their back yard. <br /> <br />Discussion ensued relating to liability, what the neighbors may or may not be agreeable to, etc. <br />If there is to be a retaining wall, the homeowners have to acquire the rights for it. <br /> <br />Summary: 1) we need to get the okay from all affected home owners on this plan including the <br />retaining wall and right-of-temporary-easement; 2) Mr. Jankowski needs to obtain all of the <br />unknown hydraulic characteristics necessary to take care of the drainage problem; 3) receive a <br />line of credit that is 150% - enough money for expenses incurred and 150% of improvements; 4) <br />do not feel we can allow them to do a letter of credit until we see they have property rights. <br /> <br />Mr. Goodrich stated that if they get the right-of-access from the neighbors and Weiss's still do <br />not like it, then we still okay the permit. <br /> <br />Councilmember Hendriksen stated that they can still have the issue of this with Orin Thompson. <br />The City Attorney suggested staff write a letter to the neighbors. <br /> <br />Mr. Jankowski did not feel the retaining wall was such a bad idea and he did not feel the <br />neighbors think it is all that bad either. <br /> <br />ADJOURNMENT <br /> <br />Consensus of the Council was to adjourn the Work Session at 9:00 p.m. <br /> <br />Respectfillly submitted, <br /> <br />/JamX~.
