Except the <br />easterly 60.00 feet thereof to be dedicated for highway purposes at the time of platting. <br />(the "Subject Property ") <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on September 10, 2001 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br />2. That the subject property is proposed to be rezoned from B1, Business and R3U, Low <br />Density Multi- Family Residential to MR, High Density Multi- Family. <br />3. That the subject property is proposed to be subdivided into three lots. One lot will be for two <br />apartment buildings, one lot for the church building, and one lot for life memorial gardens. <br />4. That City Ordinances restrict structure heights to 35 feet in all zoning districts. <br />5. That the Applicant is proposing to construct a three story apartment building that will reach a <br />maximum height of 52 feet and therefore exceeds the 35 -foot height restriction by 17 feet. <br />6. That the proposed structure is proposed to house at least 47 senior citizens, some of which <br />may have limited mobility to escape from a fire. <br />7. The applicant has provided staff with information regarding the height of the third story <br />decks. The highest point of the third story deck is 32 feet above grade. <br />8. That the 35 -foot height restriction is based on the reach capabilities of fire suppression <br />equipment in the City's fire department. <br />9. That the City of Ramsey has a joint powers agreement with the Cities of Anoka and Andover, <br />which have equipment with reach capabilities in excess of 52 feet. <br />10. That the preliminary City of Ramsey 2002 budget includes the purchase of an aerial ladder <br />truck. <br />11. On September 10, 2001, the Board of Adjustment, after reviewing the request and <br />considering the facts of the situation, denied the variance request. <br />12. On September 19, 2001, the City of Ramsey received a letter from the applicant requesting <br />an appeal of the Board of Adjustment pursuant to Section 9.03.07(1) of City Code. <br />RESOLUTION #01 -10 -398 <br />Page 2 of 3 <br />
