Board Member Johnson introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -11 -403 <br />RESOLUTION ADOPTING FINDINGS OF FACT #0584 RELATING TO A REQUEST <br />FROM CHAD AND MICHELLE HOUDE FOR A VARIANCE TO ALLOW FOR THE <br />EXISTING RESIDENCE TO ENCROACH EIGHT AND A HALF FEET INTO THE <br />REAR YARD SETBACK AND AN ADDITION TO THE EXISTING STRUCTURE <br />ENCROACH TWENTY FEET INTO THE REAR YARD SETBACK ON THE <br />PROPERTY LOCATED AT 6831 146 CIRCLE. <br />WHEREAS, Chad and Michelle Houde, hereinafter referred to as "Applicants," have <br />properly applied for a Board of Adjustment variance from Section 9.20.12 of the Ramsey City <br />Code to allow for the existing residence to encroach eight and a half feet into the rear yard <br />setback and an addition to the existing structure to encroach twenty feet into the rear yard setback <br />on the property located at 6831 146 Circle and legally described as follows: <br />Lot 25, Block 1, Regency Ponds, Anoka County, Minnesota <br />( "Subject Property "). <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Board of Adjustment for a public hearing pursuant <br />to Section 9.03.05 of the Ramsey City Code on November 5, 2001, and that said public <br />hearing was properly advertised, and that the minutes of said public hearing are hereby <br />incorporated as a part of these findings by reference. <br />2. That the Subject Property is zoned R -1U Single Family Residential Urban. <br />3. That the Subject Property is surrounded by R -1U Single Family Residential Urban zoning <br />to the north, south, and west. To the west, the property is bounded by land designated I, <br />Industrial, and is the former landfill site. <br />4. That the existing structure was constructed in 1998 and encroaches 8.5 feet into the rear <br />yard setback. <br />5. There is no evidence that a variance was granted by the City of Ramsey to allow the <br />existing structure encroachment. <br />6. That the Applicant is proposing to construct a 336 square foot addition to the existing <br />principal structure that will be approximately 15 feet from the rear property line. <br />• 7. That Section 9,20.11 of the Ramsey City Code requires a 35 -foot rear yard setback. <br />
