• <br />8. That the Subject Property is a pie- shaped lot at the end of the cul -de -sac. <br />9. That the existing structure is located on the lot in such a way as to make impossible to <br />locate the addition without encroaching into the rear yard setback. <br />10. That the rear yard abuts property previously used as a landfill. <br />11. That, if granted, the residential structure will be located no closer than 32 feet from the <br />southern side lot line and 15 feet from the rear lot line. <br />12. That, if granted, the variance will not increase the congestion in the public street. <br />13. That, if granted, the variance will not adversely impact the degree of public health, safety <br />and general welfare provided for in the Ramsey City Code. <br />14. That, if granted, the variance will not diminish established property values within the <br />neighborhood. <br />15. That the unique circumstances on the Subject Property do not result from the actions of the <br />Applicant. <br />16. That, if granted, the variance will not grant the Applicant any special privilege that is <br />denied to the owners of other land in the same district. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Watson <br />Board Member Brauer <br />Board Member Sweet <br />and the following voted against the same: <br />None <br />and the following abstained: <br />None <br />and the following were absent: <br />Board Member Kociscak <br />Board Member Reeve <br />RESOLUTION #01 -11 -403 <br />Page 2 of 3 <br />
