• <br />• <br />1. That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on November 5, 2001 and that said public hearing was properly <br />advertised and that the minutes of said public hearing are hereby incorporated as a part of <br />these findings by reference. <br />2. That the subject property is proposed to be rezoned from B1 Business a to R -3U Multi - <br />Family Residential to facilitate a townhouse development. <br />3. That City Ordinances restrict structure heights to 35 feet in all zoning districts. <br />4. That the Applicant is proposing to construct townhouse units that will reach a maximum <br />height of 38 feet and therefore exceeds the 35 -foot height restriction by 3 feet. <br />5. That the 35 -foot height restriction is based on the reach capabilities of fire suppression <br />equipment in the City's fire department. <br />6. That the City of Ramsey has a joint powers agreement with the Cities of Anoka and Andover, <br />which have equipment with reach capabilities in excess of 52 feet. <br />7. That the preliminary City of Ramsey 2002 budget includes the purchase of an aerial ladder <br />truck. <br />8. That the special conditions causing the undue hardship, restrictions based on fire suppression <br />reach capabilities, do not result from the actions of the Applicant. <br />9. That if granted, the variance will not grant special privilege that is denied to other owners of <br />lands, structures or buildings in the same district. <br />10. That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br />11. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br />Zoning Chapter or other property in the area. <br />12. That if granted, the variance will not endanger public safety. <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson, and upon vote being taken thereon, the following voted in favor thereof: <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Watson <br />RESOLUTION #01 -11 -405 <br />Page 2 of 3 <br />
