Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br />RESOLUTION #01 -12 -425 <br />A RESOLUTION ADOPTING FINDINGS OF FACTS AND DENYING A REQUEST <br />FOR AN AMENDMENT TO THE COMPREHENSIVE PLAN <br />WHEREAS, on June 15, 2001, the City of Ramsey received a request for an amendment <br />to the Comprehensive Plan from Bulow, Inc. (the Applicant) for the purpose of amending the <br />land use designation of the following legally described property from commercial to high density <br />residential: <br />Lot 1, Block 1, Bulow's Addition, Anoka County, Minnesota <br />(the Subject Property) <br />WHEREAS, the Subject Property is located within the boundaries of the Metropolitan <br />Urban Service Area and the Critical River Overlay Distrist; and <br />WHEREAS, the property has been designated for commercial uses since the 1980 <br />Comprehensive Plan; and <br />WHEREAS, the Comprehensive Plan Amendment approved in 1995 retained the <br />commercial land use designation on the Subject Property; and <br />WHEREAS, March 2001 Draft Comprehensive Plan proposes to retain the commercial <br />land use designation on the Subject Property; and <br />WHEREAS, the City of Ramsey Economic Development Authority has engaged the <br />firm of Hoisington Koegler Group Inc. to prepare a Concept Plan For The Highway 10 Corridor <br />and the June 10, 2001 draft of that Plan proposes to retain a commercial land use designation on <br />the Subject Property; and <br />WHEREAS, Section 9.20.31 (Planned Unit Development) establishes that rezoning to a <br />Planned unit Development prior to development an acceptable preliminary site plan is not <br />permitted; and <br />WHEREAS, the Ramsey Planning Commission met on October 4, 2001, conducted a <br />public hearing, and recommended that the Ramsey City Council deny the request for an <br />amendment to the Comprehensive Plan; and <br />WHEREAS, the City Council has determined that changing the land use designation to <br />high density residential is not beneficial in the Critical River Corridor and is inconsistent with <br />the Comprehensive Plan; and <br />
