Presentation <br /> <br />Community Development Director Trudgeon explained in conjunction with a minor subdivision, <br />Oakwood Land Development is seeking to vacate an existing 30-foot drainage and utility <br />easement and replace it with a 20-foot easement in order to accommodate one additional lot on <br />the existing property. The applicant is seeking to vacate all the easements on the property legally <br />described as Lot 1, Block 3, River Pines 5t~ Addition. The applicant intends to replace all <br />existing easements according to the new plat of River Pines 6th Addition, with the exception that <br />the northern easement would be reduced from 30 feet to 20 feet. The Engineering Department <br />has reviewed this request, and finds it acceptable. Mr. Trndgeon advised staff recommends <br />introduction of the enclosed ordinance to vacate the existing easements on Lot 1, Block 3, River <br />Pines 5th Addition. <br /> <br />Cit~enln~ut <br /> <br />David Hoffnagle, 5741 - 158th Court NW, stated this plot of land is right behind his house. <br />There is a little ditch area that collects water, and he is concerned about what will happen if this <br />is made into two lots. He measured the property today, and there is enough room for two houses, <br />except for the pipe. He inquired if the pipe will be kept in the current location or if it will be <br />moved further over. <br /> <br />Community Development Director Trudgeon replied the pipe will not be removed and reviewed <br />the drainage and utility easement. He explained the 30-foot easement will become a 20-foot <br />easement, and there will be new drainage and utility easements along the lot line. Nothing <br />should change with the drainage patterns in the area, and Mr. Hoffnagle's concern is noted. <br /> <br />Mr. Hoffnagle asked if there is anything that will have to be filled in with the pond areas, and if <br />lots will be extended to go back into that area. <br /> <br />Community Development Director Trudgeon reviewed the plan for the lots. He indicated he is <br />not aware of adjustments to the drainage and ponding. If Mr. Hoffnagle has any more questions <br />he should feel free to contact City Hall. <br /> <br />Mayor Gamec explained in general drainage is not allowed to affect another person's property. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to close the public <br />heating. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Olson, Elvig, Jeffrey, <br />Pearson, and Strommen.
