Mr. Gordon suggested that staff to do more work on Subd. 2 and bring it back at a future <br />meeting. <br />Councilmember Anderson noted that the proposed added language in Subd. 6 does not make <br />sense. She recommended using the same language under interim use permit. <br />Mr. Gordon replied that he would make the language the same in both sections. <br />The Chapter 9 Committee discussed if the City should be notifying the Conditional Use Permit <br />holder of the expiration of the conditional use permit. <br />Mayor Gamec felt that the burden should fall on the applicant. He did not want to place that <br />burden on the City and then have the City at fault if a notice was missed. <br />Principal Planner Trudgeon noted that that wording is typically included in all conditional use <br />permits that places the burden on the applicant. <br />Commissioner Watson inquired as to what the City currently has for a flagging system. <br />Principal Planner Trudgeon replied that there is no formal system. <br />Commissioner Watson felt that the onus should fall on the property owner to renew the <br />conditional use permit. <br />Councilmember Hendriksen expressed concern with a permit becoming null and void if the permit <br />is not initiated or utilized for one year. He explained that there are some permits that are granted <br />with the anticipation that the use will go on forever, but there might be circumstances where they <br />use may temporarily cease with full intention to restart at some point and he does not want the <br />permit to become void in those situations. <br />Principal Planner Trudgeon noted that an extension could be requested. <br />Councilmember Hendriksen replied that if someone were to become seriously ill it would not be <br />their first priority to notify the City. He stated that he wants to make sure that a City that might <br />want to be punitive towards them will not penalize people. <br />Councilmember Anderson noted that a conditional use permit is endless as long as the terms of <br />the permit are complied with. <br />Councilmember Hendriksen stated that the wording in City Code states that if a use ceases for a <br />year the permit will be terminated, and he could think of numerous situations where that may <br />occur. <br />Councilmember Anderson replied that there are some uses that the City just might want to get rid <br />off. <br />Chapter 9 Committee/January 31, 2002 <br />Page 5 of 11 <br />
