Councilmember Hendriksen stated that that is what he wants to protect from happening. <br />Chairperson Nixt inquired as to what Councilmember Hendriksen was proposing. <br />Councilmember Hendriksen replied that he did not agree with the one-year non-use limitation. <br />Commissioner Sweet stated that she does not want people to think they can ignore something <br />because the City does not mind even if the residents do mind. <br />Councilmember Hendriksen explained that he is talking about situations where urban expansion <br />eliminates the uses. <br />Mayor Gamec replied that as times change some uses are no longer appropriate. <br />Chairperson Nixt stated that they are talking about a discontinuation of a use, but if someone was <br />granted a conditional use permit for an accessory building how could they discontinue the use. <br />Councilmember Hendriksen gave a scenario of where a use could be discontinued for 12 months <br />temporarily with the intention of continuing the use at a later date. <br />Mayor Gamec stated that the scenarios presented by Councilmember Hendriksen are unique <br />situations and it would be difficult to identify all of those situations. <br />Councilmember Hendriksen stated that the City has gone out of their way to say the use will cease <br />in a year if it is not used so they have affirmatively made a decision. He felt the other side of the <br />issue should be addressed. <br />Councilmember Zimmerman recommended that the consultant draft some language to address <br />some of the concerns. <br />Councilmember Hendriksen stated that he would like to see some language that would protect <br />someone who has made a significant investment from having their conditional use permit from <br />expiring just because the use does not occur for one year. <br />Mr. Gordon recommended that staff come back with some discussion topics for the next meeting <br />and then draft the appropriate language. <br />Councilmember Anderson inquired as to why the language under Subd. 8 was deleted. <br />Principal Planner Trudgeon explained that the language was deleted so that performance security <br />could be required in cases such as approving a conditional use permit for an accessory structure in <br />the front yard. <br />Chapter 9 Committee/January 31, 2002 <br />Page 6 of 11 <br />
