Councilmember Kurak stated that any new development should require a screening fence along <br />any major thoroughfare and barbed wire fences should be restricted based on lot size. <br />Councilmember Hendriksen stated that if the theory is restrictions are based on lot size, then they <br />have to let them be entitled to what is permitted. He stated that there is something wrong with <br />drawing a hypothetical line and changing what can or cannot be permitted on a parcel. <br />Commissioner Watson inquired if a home on five acres burned down could they rebuild as it was. <br />Mr. Gordon replied yes. <br />Councilmember Anderson stated that currently they allow a four -foot fence in the front and eight <br />foot in the back so why are they changing. <br />Mr. Gordon replied that based on the discussion from last meeting, it seemed that there needed to <br />be a difference between urban and rural areas. <br />Councilmember Hendriksen inquired if someone owned a property for 50 years and the MUSA <br />expands to include their property, have their restrictions have changed? <br />Councilmember Kurak replied that the property owner could continue the use, but if they change <br />something, then they have to comply with the new regulations. <br />Commissioner Reeves stated that it was time to move on. <br />Councilmember Hendriksen stated that someone can lose their grandfathering by ceasing activities <br />for six month. <br />A heated discussion occurred regarding the issue of grandfathering. <br />Councilmember Hendriksen left the meeting. <br />Mr. Gordon reviewed the proposed changes regarding sod. <br />Commissioner Watson stated that he would like to see that after one year the City will sod a <br />property and bill the property owner. <br />Councilmember Kurak presented some proposed language for new developments within the <br />MUSA, which would require sod in the front yard. <br />Councilmember Anderson replied that she would like to allow homeowners the ability to seed <br />their yards. <br />Commissioner Reeves inquired if most of the those issues were addressed in development <br />agreements. <br />Chapter 9/April 25, 2002 <br />Page 7 of 9 <br />
