53 The Contractor will keep one record copy of all Specifications, Plans, Addenda, <br /> modifications, and Shop Drawings at the Work site in good order and annotated to show all changes <br /> made during the construction process. These shall be made available to the Engineer as the Project is <br /> completed. <br /> ARTICLE 6. Patent Fees and Royalties <br /> The Contractor will pay all license fees and royalties and assume all costs incidental to the use of any <br /> invention, design, process or device which is the subject of patent rights or copyrights held by others. <br /> The Contractor will indemnify and hold harmless the Owner and the Engineer and anyone directly or <br /> indirectly employed by the Owner from and against all claims, damages, losses and expenses <br /> (including attorney's fees) arising out of any infringement of such rights during or after completion of <br /> the Work, and shall defend all such claims in connection with any alleged infringement of such <br /> rights. <br /> ARTICLE 7. Work by Others and Subcontractors <br /> 7.1 The Owner may perform additional work related to the Project or may let other direct <br /> contracts therefrom which shall contain general conditions similar to these. The Contractor will <br /> afford the other contractors who are parties to such direct contracts (or the Owner, if performing the <br /> additional work), reasonable opportunity for the introduction and storage of materials and equipment <br /> and the execution of work, and shall properly connect and coordinate the Work with other <br /> contractors. <br /> 7.2 If any part of the Contractor's Work depends upon the work of any such other contractor (or <br /> the Owner) for proper execution or results, the Contractor will inspect and promptly report to the <br /> Engineer in writing any defects or deficiencies in such work that render it unsuitable for such proper <br /> execution and results. The Contractor's failure to report shall constitute an acceptance of the other <br /> work as fit and proper for the relationship of his Work except as to defects and deficiencies which <br /> may appear in the other work after the execution of this Work. <br /> 73 The Contractor will do all cutting, fitting and patching of the Work that may be required to <br /> make several parts come together properly and fit to receive or be received by such other work. The <br /> Contractor will not endanger any work of others by cutting, excavating or otherwise altering other's <br /> work and will only cut or alter their work with the written consent of the Engineer. <br /> 7.4 Within 10 Calendar Days of execution of this Agreement, the Contractor will submit to the <br /> Engineer for acceptance a list of the names of Subcontractors and such other persons and <br /> organizations (including those who are to furnish materials or equipment fabricated to a special <br /> design) proposed for those portions of the Work for which the identity of the Subcontractors and <br /> other persons and organizations must be submitted as specified in the Contract Documents. Prior to <br /> the execution of the Work, the Engineer will notify the Contractor in writing if either the Owner or <br /> the Engineer, after due investigation, has reasonable objection to any Subcontractor, person or <br /> organization on such list. The failure of the Owner or the Engineer to make obj ection to any <br /> Subcontractor, person or organization on the list prior to the execution of the Work shall constitute an <br /> acceptance of such Subcontractor, person or organization.
