The proposed lots will be served by a common septic system, constructed to connect to <br />municipal sewer and water when they become available to the property. The septic system is <br />proposed to be shared with the Kelly Acres development to the north and is located within Outl0t <br />A. General details concerning soil type, and the design and location of the community septic have <br />been submitted. The community septic system will require an MPCA permit. Preliminary plat <br />approval was contingent upon receiving this permit. <br /> <br />The proposed site of all drainfields must be at least 300 feet from the nearest well. This limits the <br />location of the drainfield site to the southwest comer of the outiot, and limits the location for a <br />secondary site. The plat has been requested to be revised to show an alternative location for a <br />secondary site. <br /> <br />Sidewalks are proposed on the west side of Wolverine Street and Tiger Street and north side of <br />170th and 171~ Avenues. A 'mail is proposed on the east side of Armstrong Boulevard, as directed <br />by the Master Parks and Trails plan. <br /> <br />A traffic generation study was conducted for the proposed Prairie Meadows/Kelly Acres <br />subdivisions. It was determined that the proposed lots will not have a significant impact on any <br />intersections, and no upgrades are required, except to install stop signs on 170th and 171st Avenue <br />at Tiger Street. <br /> <br />The applicant is required by City Code to submit a management agreement with an entity <br />responsible for maintaining and monitoring the community septic system. Also, the City requires <br />a copy of the Homeowners' Association (HOA) Articles of Incorporation and the bylaws before <br />releasing the plat for recording. These documents must outline the financial responsibility of the <br />HOA to provide on-going maintenance and monitoring of the community septic system and <br />watermain pipes, and a payment into a Sewer and Water Trunk Fund. The applicants will also be <br />asked to enter into an Utility Operating Agreement with the City, the HOA, and the management <br />entity. This agreement will outline the responsibilities of each entity for the construction, <br />maintenance, and replacement of the septic system. <br /> <br />A tree preservation, grading, and drainage plans have been submitted, and are generally <br />acceptable to the City, though some modifications are required as referenced in the City Staff <br />Review Letter dated June 23, 2006. <br /> <br />The City Council approved the preliminary plat for this project on April 11, 2006 with the <br />following contingencies: <br /> <br />I. Compliance ~ith City Staff review letter dated February 28, 2006, revised April 5, 2006. <br />2. The developer obtaining a permit for community septic system construction from the <br /> Minnesota Pollution Control Agency. <br />3. The developer engaging the services of a professional management firm to manage the <br /> community septic system. <br />4. The City approving the Articles of Incorporation and Declaration of Covenants for the <br /> Home Owner's Association at Final Plat. <br /> <br />-256- <br /> <br /> <br />
