At a minimum the surety must be <br />adequate to insure payment of sewer and water truck and hookup up £ees (SAC and WAC) at any <br />time in the future that they may be extended to service this site. It will also be the developer's <br />responsibility to notify potential purchasers of cluster lots of the possibility of future <br />development on the remainder of the parcel. The notice must include a copy of the Urban <br />Development Plan required as part of City Code. A copy of this notice shall be sent to the City. <br />The developer shall obtain a signed acknowledgement fi.om the purchaser stating that the <br />purchaser has reviewed the future development notice, and understands that the remnant parcel <br />may be developed in the future. Also, HOA documents must notify property owners that they <br />will be required to connect to the municipal sewer and water system when it becomes available. <br /> <br />Please submit all HOA documents, outlining the above items. <br /> <br />Park Dedication: The 2006 park dedication rate is $2,400 per residential lot and will be due <br />prior to the release of the final plat. <br /> <br />Trail Fee: Trail Fees must be paid for new lots created prior to release of the final plat for <br />recording. Additionally, as part of the Park and Trail Plan, a l0 foot bituminous trail along <br />Armstrong Boulevard is required along the extent of the plat. The trail must be platted in an <br />ea.~elxlent. ' <br /> <br />Sewer and Water Trunk Fee: The future payment of sewer and water trunk fees for the <br />proposed lots will be detailed in the Development Aga'eement for the plat and/or in the HOA <br />documents. A surety will be required to insure payment of sewer and water la-ack and hookup up <br />fees (SAC and WAC). <br /> <br />Stormwater Management Fee: A stormwater management fee must be paid for all new lots <br />being created. The rate in effect at the t/me of final plat approval mu.st be paid prior to'the City's <br />release of the £mal plat for recording. <br /> <br />Development Agreement: Due to the mount of information still outstanding regarding your <br />£mal plat submittal, it is not possible to produce a full development agreement at this time. A <br />draft copy has been included in the Council agenda packet. At the time that all plans regarding <br />the community septic system and engineering have been satisfactorily completed, a full <br />agreement will be separately approved by City Council. ~ <br /> <br />Utility Operating Agreement: The developer will be required to enter into an operating <br />agreement with the City and the homeowners' association to establish the fights and <br />responsibilities of each party in constructing, maintaining, and £mancing the community septic <br />system, the watermains, and the sewer and water trunk and access charges. <br /> <br />-266- <br /> <br /> <br />
