development, and at the time it develops it would develop under the regulations of the <br />cluster ordinance, such as relating to ~eenspace requirements. <br /> <br />Community Development Director Trudgeon replied any development that is currently <br />completed under the existing ordinance could not 'occur unless sewer and water is <br />available, and would develop under urban regulations. The ghost platting is not being <br />approved at this time, and would be platted as a large outlot that would have to go back <br />through the process to be platted. The Council seated at that time can make a <br />determination on what is acceptable. <br /> <br />Councilmember Strommen questioned if the area that is currently being gt~ost platted <br />would fall under the new requirements in place when it is platted if this application were <br />to be approved at this time without open space requirements included in the cluster <br />ordinance. <br /> <br />Community Development Director Trudgeon replied any urban development does not <br />require dedicated open space, but it could be stipulated that any further development in <br />the area originally designated as a cluster subdivision, whether or not the development is <br />under urban levels, needs to have certain amenities. <br /> <br />Councilmember Cook noted the Council had discussed that it is not important to get <br />greenspace now; it is important to get the funding for the greenspace out of the remaining <br />land, and to require that land at the time the remainder of the cluster is developed. He <br />stated it should be clear that the ghost pla~ing is not exactly what will occur. It is a <br />representation of how the rest of the land could be developed, and takes into <br />consideration issues such as traffic flow, ingress and egress. It involves more master <br />planning of the area than would be present if it were not required. <br /> <br />Councilmember Elvig noted as the cluster ordinance is studied there will be parameters <br />added regarding ~eenspace that are not yet included. He questioned if these <br />requirements could be included in conditions for this application. <br /> <br />Community Development Director Trudgeon replied these requirements could be applied <br />to this application. He noted these developments are stuck in the transition of trying to <br />improve the ordinance and dealing with what is on the books at this time. <br /> <br />Councilmember Cook stated there are two issues the Council wants to work out during <br />this moratorium; one being the greenspace and open space, and the second being the <br />management of the community septic system, which is addressed in condition no. 4. He <br />stated he likes this plan and thinks there are benefits to the City in going forward with <br />this application at this time. He requested input from the applicant regarding the five <br />contingencies recommended by staff, in particular to the fourth contingency of a <br />professional management firm overseeing the well and septic system. <br /> <br />Steve Sletmer, President of Technical Design representing Kelly Acres and Rum River <br />Prairie, stated the applicants concur with the staff report as revised on April 5, 2006. <br /> <br />-271- <br /> <br /> <br />
